Memorandum for the Secretary of State, the Secretary of Defense

Subject: Determination to Authorize the Furnishing of Commodities and Services for the United Nations War Crimes Tribunal Established with Regard to the Former Yugoslavia

Pursuant to the authority vested in me as President of the United States, including section 554 of the Foreign Operations, Export Financing, and Related Programs Appropriations Act, 1999, as enacted in Public Law 105-277, I hereby: (a) determine that a drawdown of up to $5 million of commodities and services from the inventory and resources of the Department of Defense will contribute to a just resolution of charges regarding genocide and other violations of international humanitarian law; and (b) direct the drawdown, pursuant to section 552(c) of the Foreign Assistance Act of 1961, as amended, 22 U.S.C. 2348a (the "Act"), of up to $5 million in commodities and services from the inventory and resources of the Department of Defense for the United Nations War Crimes Tribunal established with regard to the former Yugoslavia by the United Nations Security Council, without regard to the ceiling limitation contained in section 552(c)(2) of the Act.

The Secretary of State is authorized and directed to report this determination to the Congress and to arrange for its publication in the Federal Register.
