Executive Order 8697—Transfer of Certain Lands From the Secretary of the Interior to the Secretary of Agriculture

NEW MEXICO

Whereas the hereinafter-described lands, together with the improvements thereon, acquired by the United States in connection with the Jemez Project, LI-NM-9, in Sandoval County, New Mexico, under authority of Title II of the National Industrial Recovery Act (48 Stat. 200) and the Emergency Relief Appropriation Act of 1935 (49 Stat. 115), were transferred by Executive Order No. 7792 of January 18, 1938, from the Secretary of Agriculture to the Secretary of the Interior for administrative purposes; and

Whereas such lands are submarginal and not primarily suitable for cultivation; and

Whereas I find such lands suitable for the purposes of Title III of the Bankhead-Jones Farm Tenant Act, approved July 22, 1937 (50 Stat. 522, 525), and the related provisions of Title IV thereof:

Now, Therefore, by virtue of and pursuant to the authority vested in me by section 32(a) of Title III and section 45 of title IV of the said Bankhead-Jones Farm Tenant Act, it is ordered (1) that the hereinafter-described lands, together with the improvements thereon, acquired in connection with the said Jemez Project, LI-NM-9, be, and they are hereby, transferred from the Secretary of the Interior to the Secretary of Agriculture, and (2) that all the right, title, and interest of the United States in and to such lands be, and they are hereby, transferred to the Secretary of Agriculture for use, administration, and disposition in accordance with the provisions of Title III of the said Act and the related provisions of Title IV thereof: Provided, however, that grazing facilities on such lands shall be made available to the Pueblo Indians to the extent of 400 cattle units yearlong:
