Executive Order 12222—Generalized System of Preferences for Developing Countries

AMENDING THE GENERALIZED SYSTEM OF PREFERENCES

By virtue of the authority vested in me by the Constitution and statutes of the United States of America, including Title V of the Trade Act of 1974 (19 U.S.C. 2461 et seq.), as amended by Section 1111 of the Trade Agreements Act of 1979 (93 Stat. 315), and Section 604 of the Trade Act of 1974 (19 U.S.C. 2483), and as President of the United States of America, in order to provide for the continuation, to the greatest extent possible, of preferential treatment under the Generalized System of Preferences (GSP) for articles which are currently eligible for such treatment from countries designated as beneficiary developing countries, notwithstanding the numerous changes to the Tariff Schedules of the United States (TSUS) (19 U.S.C. 1202) which have resulted from the enactment of Title II of the Trade Agreements Act of 1979 (93 Stat. 194 et seq.) and Proclamation 4768 to Carry Out the Agreement on Implementation of Article VII of the General Agreement on Tariffs and Trade (the Customs Valuation Code) and for Other Purposes, to make technical corrections to Executive Order No. 11888, of November 24, 1975, as amended, and to make conforming modifications to the TSUS, it is hereby ordered as follows:

SECTION 1. Annex II of Executive Order No. 11888, as amended, listing articles that are eligible for benefits of the GSP when imported from any designated beneficiary developing country, is further amended as provided in the Annex to this Order, attached hereto and made a part hereof.

SEC. 2. Annex III of Executive Order No. 11888, as amended, listing articles that are eligible for benefits of the GSP when imported from all designated beneficiary countries except those specified in General Headnote 3 (c) (iii) of the TSUS, is further amended by deleting items 114.05 and 315.55 therefrom, and adding items 114.04 and 114.06 thereto.

SEC. 3. General Headnote 3(c) (iii) of the TSUS, listing articles that are eligible for benefits of the GSP except when imported from the beneficiary countries listed opposite those articles, is modified by deleting therefrom the following:

"114.05 Thailand

315.55 Philippines";

and by adding thereto, in numerical se-

quence, the following:

"114.04 Thailand

114.06 Thailand".

SEC. 4. The amendments made with respect to items 315.55, 470.57, 772.69, 772.70, and 772.71 by Sections 1, 2, and 3 of this Order shall be effective as to articles that are both (1) imported on or after January 1, 1976, and (2) entered, or withdrawn from warehouse for consumption, on or after July 1, 1980.

SEC. 5. The amendments made by Sections 1, 2, and 3 of this Order, with the exception of those listed in Section 4 above, shall be effective as to articles that are exported to the United States on and after July 1, 1980.
