Executive Order 11939—Basic Allowances for Quarters

September 30, 1976

By virtue of the authority vested in me by Sections 1009 (c) and (d) of Title 37 of the United States Code, as added by Section 303 of the Department of Defense Appropriation Authorization Act, 1977, Public Law 94-361, July 14, 1976, and as President of the United States of America and Commander in Chief of the Armed Forces, it is hereby ordered as follows:

SECTION 1. Section 403 of Part IV of Executive Order No. 11157 of June 24, 1964, as amended, is further amended by :

(a) inserting "(a)" after "Sec. 403.",

(b) redesignating clauses (a), (b), and (c) as (1), (2) and (3) respectively, and redesignating clauses (i) and (ii) as (A) and (B), respectively, and

(c) adding the following new subsection (b):

"(b) Whenever the President exercises his authority under Section 1009(c) of Title 37 of the United States Code, to allocate up to 25 percent of certain increases in basic pay to basic allowances for quarters, a member without dependents who, under Section 403 (b) or (c) of that title, is not entitled to a basic allowance for quarters shall become entitled to a portion of such basic allowance for quarters. The amount of such partial basic allowance for quarters shall equal the amount of any increases in basic pay which are allocated by the President to the basic allowance for quarters.".

SEC. 2. This Order shall become effective on October 1, 1976.
