Statement of Administration Policy: S. 605 - Consumer Product Safety Commission (CPSC) Authorization Act of 1989

STATEMENT OF ADMINISTRATION POLICY

The Administration would have no objection to the enactment of S. 605 if the bill were amended to delete the following provisions:

  • Section 7, which would require that the CPSC promulgate regulations within one year of publishing the advance notice of proposed rulemaking. This rigid requirement would remove the agency's discretion to determine the best course of action in responding to product safety problems, and

  • Section 9, which would prohibit consideration of the benefits and costs of a voluntary remedial action against a consumer product. This would prevent the CPSC from making fully informed decisions regarding the effects of its action.
