Proclamation 2657—National Defense Pipe Line the Texas-Empire Pipe Line Company

A Proclamation

Whereas the act of Congress entitled "An Act to facilitate the construction, extension, or completion of interstate petroleum pipe lines related to national defense, and to promote interstate commerce", approved July 30, 1941 (55 Stat. 610), as amended, vests in the President certain powers relating to the construction, extension, completion, operation and maintenance of interstate pipe lines related to national defense:

Now, Therefore, I, Harry S. Truman, President of the United States of America, under and by virtue of the authority vested in me by the said act, as amended, do hereby find and proclaim:

(1) That for national-defense purposes it is necessary that there by constructed and completed a pipe line system for the transportation of petroleum and petroleum products moving in interstate commerce originating in the vicinity of Cushing, Oklahoma, and extending in a northeasterly direction to a point at Heyworth, Illinois, the route of which is on file in the Office of Petroleum Administrator for War, detail survey map of which shall be recorded in the said office:

(2) That The Texas-Empire Pipe Line Company, a private corporation organized under the laws of the State of Delaware, has commenced the work necessary for the construction of the said pipe line and facilities under Project NC-8613 approved by the War Production Board on March 26, 1945, and represents that it is prepared to complete the said pipe line and facilities; and

(3) That for the purpose of construction, completion, operation, and maintenance of the said pipe line system, it is necessary that the said Company have the right, as provided in the aforesaid act, as amended, by the exercise of the right of eminent domain, to acquire along the route in Logan, Dewitt, and McLean Counties, Illinois, between the said Company's Beason Junction in Logan County, Illinois, and its Heyworth Station in McLean County, Illinois, a distance of approximately seventeen miles, easements and rights-of-way not to exceed fifty feet in width, for the construction, completion, operation, maintenance, and removal of the pipe lines, including the right of access thereto over adjoining lands, and the said right to exercise the right of eminent domain is hereby granted to the said Company: Provided, that such right of eminent domain shall be exercised by the said Company for the aforesaid purposes prior to June 30, 1946: And provided further, that the said pipe line and facilities herein identified shall be constructed, complete, operated, and maintained subject to such terms and conditions as the President may hereafter from time to time prescribe as necessary for national-defense purposes.
